Cart 8 Marketplace - Terms and Conditions

1. About these terms

These Terms and Conditions ("Terms") govern your use of the Cart 8 website at www.cart8.com.au ("Site") and any orders you place through the Site. By creating an account, browsing the Site, or placing an order, you agree to be bound by these Terms.

Cart 8 Marketplace (ABN 87 689 906 803) ("Cart 8 Marketplace", "we", "us", "our") operates an online food marketplace that connects customers with local producers, growers, makers, and brands ("Producers"). We are not the manufacturer or supplier of the products listed on the Site. Each product is supplied by an independent Producer.

Our pick, pack, and delivery services are operated by our fulfilment partner, Pick Pack It Pty Ltd (ABN 11 694 739 305) ("Fulfilment Partner"). References to "our warehouse", "our facility", or "our delivery fleet" in these Terms refer to the services provided by our Fulfilment Partner on our behalf.

We may update these Terms from time to time. The current version will always be available on the Site. Continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.

2. Definitions

"Account" means the customer account you create on the Site.

"Fulfilment Partner" means Pick Pack It Pty Ltd, our contracted pick, pack, and delivery partner.

"Customer" means any person who creates an Account or places an Order through the Site.

"Delivery Zone" means the geographic areas we currently service for delivery, as published on the Site.

"Facility" means the centralised warehouse and fulfilment centre operated by our Fulfilment Partner for receiving, storing, picking, packing, and dispatching Products.

"Order" means a request to purchase one or more Products through the Site.

"Producer" means any independent business that lists and sells products on the Cart 8 marketplace.

"Product" means any item listed for sale on the Site by a Producer.

"Site" means the Cart 8 website at www.cart8.com.au and any associated mobile applications.

3. Account registration

To place an Order, you must create an Account on the Site. When registering, you agree to:

  • provide accurate, current, and complete information;
  • maintain and update your information to keep it accurate;
  • keep your password secure and confidential;
  • accept responsibility for all activity that occurs under your Account;
  • notify us immediately of any unauthorised use of your Account.

You must be at least 18 years of age to create an Account. We reserve the right to suspend or terminate any Account at our discretion if we reasonably believe these Terms have been breached.

4. Products and Producers

Cart 8 Marketplace is a marketplace. The Products listed on the Site are supplied by independent Producers, not by Cart 8 Marketplace. While we work closely with our Producers to maintain quality standards, each Producer is responsible for:

  • the accuracy of product descriptions, images, ingredients, and allergen information;
  • compliance with all applicable food safety laws, including the Food Standards Australia New Zealand Act 1991 (Cth) and the FSANZ Food Standards Code;
  • holding all required licences, permits, and registrations for the manufacture and sale of their products;
  • product quality, freshness, and fitness for purpose.

We display product information as provided by each Producer. While we take reasonable steps to verify this information, we do not independently test or certify the Products. If you have specific dietary requirements or allergen concerns, we recommend contacting the Producer directly through the Site before purchasing.

5. Pricing and payment

All prices on the Site are displayed in Australian dollars (AUD) and include GST unless otherwise stated.

Prices are set by each Producer and may change without notice. The price at the time you place your Order is the price you will be charged.

A delivery fee applies to each Order. Delivery fees are displayed at checkout and vary depending on your Delivery Zone. Cart 8 may offer free or reduced delivery from time to time at our discretion.

Payment is processed at the time of Order. We accept payment methods as displayed on the Site at checkout. By placing an Order, you authorise us to charge your nominated payment method for the total Order amount, including delivery fees.

If a Product is unavailable after you have placed your Order, we will notify you and refund the amount for that Product. You will not be charged for Products we cannot fulfil.

6. Orders

Placing an Order on the Site constitutes an offer to purchase the selected Products. An Order is not confirmed until we send you an Order confirmation by email.

We reserve the right to decline or cancel any Order for any reason, including but not limited to:

  • Product unavailability or stock issues;
  • errors in pricing or product information;
  • suspected fraudulent activity;
  • delivery address is outside our current Delivery Zones;
  • failure to process your payment.

Minimum order values may apply and will be displayed on the Site.

7. Delivery

Delivery is managed by our Fulfilment Partner, Pick Pack It Pty Ltd. Products from multiple Producers are consolidated at the Facility and delivered together in a single delivery to your nominated address.

7.1 Delivery zones and times

We deliver to areas within our published Delivery Zones, which are available on the Site. Delivery windows are selected at checkout. While we make every effort to deliver within your selected window, delivery times are estimates and not guaranteed.

7.2 Delivery requirements

You must ensure that someone is available at the delivery address to receive the Order during the selected delivery window. If no one is available, the delivery driver may leave the Order in a safe location at the delivery address at their discretion. Cart 8 Marketplace accepts no liability for Products left unattended after delivery, including spoilage, damage, or theft.

You are responsible for providing accurate delivery instructions and ensuring safe access to the delivery address.

7.3 Cold chain and temperature sensitive products

We maintain cold chain integrity from the Facility to your door using refrigerated transport and insulated packaging. Once your Order has been delivered, responsibility for correct storage and handling of temperature sensitive products transfers to you.

8. Returns, refunds, and complaints

8.1 Your rights under Australian Consumer Law

Nothing in these Terms limits your rights under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)). If a Product has a major failure or does not meet a consumer guarantee, you are entitled to a remedy including a refund, replacement, or repair as applicable.

8.2 Quality issues

If you receive a Product that is damaged, defective, spoiled, or not as described, please contact us within 48 hours of delivery. We may request photos or other evidence of the issue. We will work with the relevant Producer to resolve your complaint and, where appropriate, provide a refund or replacement.

8.3 Change of mind

Due to the nature of food products, we do not accept returns for change of mind. This does not affect your rights under Australian Consumer Law.

8.4 How to contact us

To report an issue with an Order, contact our customer service team at hello@cart8.com.au or through the contact form on the Site. Please include your Order number and details of the issue.

9. Allergens and dietary information

Products may contain allergens. Allergen and dietary information is provided by each Producer and displayed on the Product listing. While we categorise Products by dietary type (e.g. gluten free, vegan, dairy free) based on information provided by Producers, Cart 8 Marketplace does not independently verify these claims.

Products from different Producers are consolidated at the Facility. While we take reasonable care in our handling processes, we cannot guarantee that cross contamination will not occur during picking, packing, or delivery.

If you have severe allergies or specific dietary requirements, we strongly recommend reading all product labels upon receipt and contacting the Producer directly with any questions before consuming the Product.

10. Intellectual property

All content on the Site, including but not limited to text, graphics, logos, images, and software, is the property of Cart 8 Marketplace or our Producers and is protected by Australian and international intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written consent.

11. Privacy

We collect, use, and disclose your personal information in accordance with our Privacy Policy, which is available on the Site. By using the Site, you consent to our collection and use of your personal information as described in the Privacy Policy.

We may share relevant information (such as your name, delivery address, and Order details) with Producers and our Fulfilment Partner for the purpose of fulfilling your Order.

12. Limitation of liability

To the maximum extent permitted by law, Cart 8 Marketplace excludes all liability for:

  • any indirect, incidental, special, or consequential loss or damage arising from or in connection with your use of the Site or purchase of Products;
  • any loss arising from reliance on Product information provided by Producers;
  • any loss arising from the unavailability of the Site or any Product;
  • any loss or damage to Products after delivery to your nominated address.

Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition implied or imposed by any legislation that cannot lawfully be excluded or limited. This includes the Australian Consumer Law.

Where Cart 8 Marketplace is liable under a non-excludable guarantee, our liability is limited (at our option) to the replacement or re-supply of the relevant Product, or a refund of the price paid for the Product.

13. Indemnity

You agree to indemnify and hold harmless Cart 8 Marketplace, its directors, employees, and agents from and against any claim, loss, damage, liability, or expense (including reasonable legal fees) arising from or in connection with:

  • your breach of these Terms;
  • your use of the Site;
  • any fraudulent or illegal activity conducted through your Account.

14. Suspension and termination

We may suspend or terminate your Account and access to the Site at any time if:

  • you breach these Terms;
  • we reasonably suspect fraudulent or illegal activity;
  • you engage in abusive or threatening behaviour towards our staff, delivery drivers, or Producers;
  • it is required by law or regulation.

You may close your Account at any time by contacting us at hello@cart8.com.au. Closing your Account does not affect any outstanding Orders or obligations.

15. General

15.1 Governing law

These Terms are governed by the laws of South Australia, Australia. You submit to the non-exclusive jurisdiction of the courts of South Australia.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.

15.3 Entire agreement

These Terms, together with our Privacy Policy and any other policies referenced on the Site, constitute the entire agreement between you and Cart 8 Marketplace in relation to your use of the Site.

15.4 Waiver

A failure by Cart 8 Marketplace to exercise or enforce any right under these Terms does not constitute a waiver of that right.
